Rocky Mirza sends legal notices to Muslim Reviews and Course Reviews for alleged defamation

On 6th December 2018, Rocky Mirza contacted the editor of Muslims Reviews to inform him about the Pre-Action Notice for Defamation.

The legal notice was written by Rafaqat ‘Rocky’ Mirza and drafted by legal firms Hardwiche and 5RB – two london barristers’ chambers. 

The notice’s key points for alleged defamation rests on the following:

  • Mr Rafaqat founded a Ponzi Scheme, namely one which was fraudulent;
  • Mr Rafaqat should be subject to the Fraud Investigation Team of the HMRC;
  • Mr Rafaqat is using MEN as a vehicle to commit fraud;
  • Mr Rafaqat has lied about his financial status;
  • Mr Rafaqat has refused to, or unreasonably delays, refunding investors with clear entitlements to be refunded substantial sums of money, making it unlikely he will ever repay people;
  • And, in all the circumstances, Mr Rafaqat is dishonest and not to be trusted in business.

Similar legal notices were sent to Mustafa Patel and Adam Ali of Course Reviews.

Our legal defence

Muslim Reviews is preparing a legal defence, which includes initially responding to the notice. Our legal case shall include all the evidences used in our publications, and involves victims of MEN as potential witnesses.

The team at Muslim Reviews worked tirelessly, without financial reward or fame, to raising awareness of potentially fraudulent business propositions. Vulnerable cash-strapped Muslim were targeted, with our mosques and charities suddenly embroiled in unattainable goals – our work helped to limit MEN’s overreach from causing significant harm in our communities.

We believe Rocky’s legal action will ultimately fail, since our defence is strong, and because it has broad support from victims, religious figures and the wider public.

In our next post, Muslim Reviews will detail our plans. We feel that given the recent statement of Harun Rashid, we must accommodate to the new circumstances towards our overall objective of delivering justice to victims.

Standing up to injustice

Our duty is to support one another in good, and there is no greater duty than to show a unified stance against injustice. We are reminded in the following ahadith:

Narrated by Anas Ibn Malik رضي الله عنه

Allah’s Messenger (ﷺ) said: “Help your brother, whether he is an oppressor or he is an oppressed one.” People asked, “O Allah’s Messenger (ﷺ), it is all right to help him if he is oppressed, but how should we help him if he is an oppressor? The Prophet (ﷺ) said, “By preventing him from oppressing others.”

[Sahih Al-Bukhari 2444]

Narrated by Abu Musa رضي الله عنه

The Prophet (ﷺ) said, “A believer to another believer is like a building which different parts enforce each other.” The Prophet (ﷺ) then clasped his hands with the fingers interlaced (while saying that).
